General Terms and Conditions of Sale for LYLOC Renters 

These General Terms and Conditions of Sale (the “General Terms”) apply to rentals made by professional renters via the LYLOC application. LYLOC, located at 70 Cours Gambetta, Lyon 69007, manages the application. 

Before renting an item, renters must read and accept these General Terms and agree to comply with them. These Terms form a binding agreement between you (referred to as the “renter”) and the landlord, as well as, where applicable, between you and LYLOC. 

I. DEFINITIONS 

  • Renter: Refers to the user who rents or intends to rent items via the LYLOC app. The user may be a consumer or a professional. 
  • Item(s): Goods listed in LYLOC’s catalogue, which are available for rent. 
  • Rental: The agreement between a renter and a landlord for the rental of an item. 
  • Conditions: These General Terms of Sale that form a binding agreement between you and the landlord, and where relevant, between you and LYLOC. 

II. OBJECT 

These Terms define the conditions applicable to rentals made through the application, which apply directly between the renter and the landlord. 

III. RENTAL PROCESS WITH THE LANDLORD 

Steps to follow for a rental request: 

  • Access the LYLOC app and create an account. 
  • Browse the catalogue and select an item to rent. 
  • Follow the app’s instructions and validate your request. 
  • Choose a payment method and finalize the order. 

Upon validation, the renter enters into a rental agreement with the landlord and must pay the total price displayed. The payment is processed through LYLOC’s integrated secure payment system. 

IV. MAJOR FORCE  

Both LYLOC and landlords may suspend obligations in case of force majeure, meaning unforeseeable events beyond their control that prevent the fulfillment of obligations. 

V. PERSONAL DATA 

LYLOC and the landlords act as joint controllers for certain data processing under GDPR. Renters must comply with data protection laws when handling data independently. 

VI. RESOLVING DISPUTE 

Any disputes between LYLOC and the renter will be governed by the national law applicable to the renter and can be resolved as per the LYLOC General Terms. 

VII. AMENDMENTS TO THE GENERAL TERMS 

LYLOC reserves the right to unilaterally amend these Terms. Amendments will apply only to rentals made after the modification comes into effect. 

General Terms of Use (CGU): 

  1. Purpose: LYLOC connects individuals for the rental of movable property. Use of the platform implies agreement to the CGU. 
  1. User Registration: Users must create an account, ensuring information provided is accurate. Credentials are personal and must not be shared. 
  1. Account Suspension/Deletion: Users can request account deactivation at any time. LYLOC can also suspend accounts for fraud or CGU violations. 
  1. Personal Data: LYLOC collects personal data under GDPR regulations. Users have rights to access, modify, and delete their data. 
  1. Rental Process: Rentals involve selecting items from the catalogue and following the app’s process. Payments are made through the platform, and LYLOC ensures pre-authorization of security deposits. 
  1. Execution of Rentals: The platform serves as an intermediary; users are responsible for the proper execution of rental agreements. LYLOC offers mediation in case of disputes. 
  1. Ancillary Services
  • Contract Management: Automatic generation of rental contracts within the app. 
  • Comments: Users can leave feedback on others’ profiles. 
  • Deposit Management: LYLOC manages security deposits for rentals, providing pre-authorization of funds. 
  1. Liability: LYLOC is only an intermediary and cannot be held liable for non-execution of rental contracts. It is also not responsible for technical issues like app maintenance or network disruptions. 
  1. Intellectual Property: Users are prohibited from reproducing or distributing any part of the platform without prior consent from LYLOC. 
  1. Dispute Resolution: Any disputes are governed by French law and should be submitted to the courts in Lyon.
